Terms of Service

1. Acceptance of Terms
By accessing or using the Servo Scout mobile application, website, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.
These Terms constitute a legally binding agreement between you and Servo Scout ("we", "us", or "our"). We may update these Terms from time to time as described in Section 15 below.
2. Description of Service
Servo Scout is a fuel price comparison application designed for drivers in the Perth metropolitan area of Western Australia. The Service provides fuel price information sourced from:
- FuelWatch WA - official fuel pricing data published by the Government of Western Australia, updated daily; and
- Crowdsourced submissions - price corrections and updates submitted voluntarily by users of the Service.
The Service allows users to view fuel prices on a map, filter by fuel type, compare prices across stations, and submit price corrections for the benefit of the community.
3. User Accounts
Certain features of the Service require you to create an account. When you register, you agree to:
- Provide accurate, current, and complete information during registration;
- Maintain and promptly update your account information to keep it accurate and complete;
- Maintain the security and confidentiality of your login credentials;
- Accept responsibility for all activities that occur under your account; and
- Notify us immediately of any unauthorised use of your account.
You must be at least 13 years of age to create an account and use the Service. If you are under 18, you represent that you have the consent of a parent or legal guardian to use the Service. We reserve the right to request verification of your age at any time and to terminate accounts where this requirement is not met.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Submit false, misleading, or fabricated fuel price information;
- Submit prices for stations you have not personally visited or verified;
- Use the Service to send spam, unsolicited communications, or promotional material;
- Scrape, crawl, or use automated means to access the Service or extract data from it without our prior written consent;
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the application;
- Interfere with, disrupt, or place an unreasonable burden on the Service or its infrastructure;
- Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity;
- Use the Service in any manner that could damage, disable, overburden, or impair the Service; or
- Attempt to gain unauthorised access to any portion of the Service, other user accounts, or any systems or networks connected to the Service.
We reserve the right to investigate and take appropriate action, including suspending or terminating your account, if we reasonably believe you have violated these acceptable use requirements.
5. Price Accuracy Disclaimer
Fuel prices displayed in Servo Scout are for informational purposes only. We do not guarantee the accuracy, completeness, or timeliness of any price information. Crowdsourced prices are submitted by users and may not reflect current pricing at any given station. Always confirm the price at the bowser before making a purchasing decision.
While we endeavour to display accurate and up-to-date pricing information, fuel prices are subject to change without notice. FuelWatch data is typically published daily and may not reflect intra-day price movements. Crowdsourced prices are user-submitted and, while subject to community verification, may contain errors or become outdated.
You acknowledge that any reliance on price information provided through the Service is at your own risk. Servo Scout accepts no responsibility for any loss or damage arising from your reliance on price information displayed in the Service.
6. FuelWatch Data Attribution
The Service includes data from FuelWatch WA, a Government of Western Australia service administered by the Department of Energy, Mines, Industry Regulation and Safety.
Servo Scout is not affiliated with, endorsed by, or connected to FuelWatch or the Government of Western Australia. FuelWatch data is used in accordance with applicable government data licensing terms. The Government of Western Australia makes no representations or warranties regarding the accuracy or completeness of FuelWatch data as displayed in the Service.
7. User-Generated Content
When you submit fuel price corrections, ratings, or other content through the Service ("User Content"), you:
- Grant Servo Scout a perpetual, irrevocable, worldwide, royalty-free, sub-licensable licence to use, reproduce, modify, adapt, publish, distribute, and display your User Content in connection with the operation and promotion of the Service;
- Represent and warrant that you have the right to submit such User Content and that it does not infringe the rights of any third party;
- Acknowledge that User Content may be made available to other users of the Service; and
- Acknowledge that you retain no intellectual property claims over price data or other factual information submitted through the Service.
We are not obliged to monitor, review, or store User Content. We reserve the right to remove or modify any User Content at our sole discretion, including content that we determine to be inaccurate, inappropriate, or in violation of these Terms.
8. Intellectual Property
The Service and its original content (excluding User Content and FuelWatch data), features, and functionality are and shall remain the exclusive property of Servo Scout and its licensors. This includes, but is not limited to, the application design, user interface, graphics, logos, icons, and software code.
The Servo Scout name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Servo Scout. You must not use such marks without our prior written permission.
Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited right to use the Service in accordance with these Terms.
9. Premium Subscriptions
Servo Scout offers optional premium subscription plans ("Servo Scout Pro") that provide access to additional features. By subscribing, you agree to the following:
- Billing: Payment is processed securely through Stripe. You authorise us to charge your nominated payment method for the subscription fee at the time of purchase and at each renewal period.
- Auto-renewal: Subscriptions automatically renew at the end of each billing period (monthly or annually, as selected) unless you cancel before the renewal date. You will be charged the then-current subscription price at each renewal.
- Cancellation: You may cancel your subscription at any time through the app settings or by contacting us at hello@servoscout.com.au. Cancellation takes effect at the end of the current billing period. You will continue to have access to Pro features until the end of the period you have already paid for.
- Refunds: Refund requests are handled in accordance with Australian Consumer Law. If the Service has a major failure, or fails to meet a consumer guarantee, you are entitled to a refund. For other refund requests, please contact us and we will assess your request on a case-by-case basis.
- Price changes: We may change subscription pricing at any time. Any price changes will take effect at the start of your next billing period following notice of the change. If you do not agree to the new pricing, you may cancel your subscription before the change takes effect.
10. Limitation of Liability
To the maximum extent permitted by law, Servo Scout, its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to, use of, or inability to access or use the Service;
- Any conduct or content of any third party on the Service, including User Content;
- Any fuel price information obtained from the Service;
- Unauthorised access, use, or alteration of your transmissions or content; or
- Any other matter relating to the Service.
To the extent permitted by law, our total liability to you for all claims arising out of or relating to the use of the Service is limited to the amount you have paid to us in the twelve (12) months prior to the event giving rise to the claim, or one hundred Australian dollars (AUD $100), whichever is greater.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted, or modified by agreement.
11. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the Service, you are entitled to:
- Cancel your subscription and receive a refund for the unused portion; or
- Compensation for any reasonably foreseeable loss or damage.
If the failure does not amount to a major failure, you are entitled to have the issue rectified in a reasonable time. If it is not rectified within a reasonable time, you may cancel and obtain a refund for the unused portion of the subscription.
These guarantees apply regardless of any other provision in these Terms. Nothing in these Terms is intended to exclude, restrict, or modify rights that you may have under the Competition and Consumer Act 2010 (Cth), the Australian Securities and Investments Commission Act 2001 (Cth), or any equivalent state or territory legislation, where to do so would be unlawful or would render any part of these Terms void.
12. Account Suspension and Termination
We may suspend or terminate your account and access to the Service, without prior notice, for conduct that we determine, in our sole discretion:
- Violates these Terms or any applicable law;
- Is harmful to other users, third parties, or the business interests of Servo Scout;
- Involves the submission of false or misleading price data;
- Involves the use of automated tools to access the Service; or
- Is otherwise objectionable or in breach of the spirit of these Terms.
We may also terminate accounts that have been inactive for a continuous period of twelve (12) months or more, with reasonable notice provided via email to the address associated with your account.
Upon termination, your right to use the Service will immediately cease. If you have an active premium subscription at the time of termination due to your breach of these Terms, you are not entitled to a refund for the remaining subscription period, except where required by Australian Consumer Law.
13. Indemnification
You agree to defend, indemnify, and hold harmless Servo Scout, its directors, employees, partners, agents, suppliers, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to:
- Your violation of these Terms;
- Your User Content, including any fuel price submissions;
- Your use of the Service in a manner not authorised by these Terms;
- Your violation of any rights of a third party; or
- Your violation of any applicable law, rule, or regulation.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Western Australia, without regard to its conflict of law provisions.
You agree to submit to the exclusive jurisdiction of the courts of Western Australia and the Federal Court of Australia sitting in Western Australia for the resolution of any disputes arising out of or relating to these Terms or the Service.
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms will remain in full force and effect.
15. Changes to Terms
We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice before the new terms take effect, by posting a prominent notice within the app or sending a notification to the email address associated with your account.
Your continued use of the Service after the revised Terms become effective constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service and may cancel your account.
We encourage you to review these Terms periodically to stay informed of any changes.
